This policy explains how we collect, hold, use and disclose personal information through maxys.com.au, our communications and our content, video, media-production and AI-enabled workflow services.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply, and to applying practical privacy safeguards to our work.

What personal information we collect

The personal information we collect depends on how you interact with us. It may include:

  • Identity and contact details, such as your name, email address, telephone number, organisation, position and professional profile.
  • Enquiry and project information, including messages, briefs, objectives, source materials, content, files, feedback, approvals and other communications you provide.
  • Business and administrative information, such as proposals, agreements, invoicing details, payment status and records needed to manage a client, supplier or contractor relationship. Payment providers may process payment information directly.
  • Website and technical information, such as your IP address, browser and device type, referring page, pages viewed, approximate location, dates and times of visits, cookie identifiers and website diagnostic or security data.
  • Information from third parties or public sources, such as a referral, professional directory, social-media profile or information supplied by a client or service provider where relevant to our work.

We do not seek to collect sensitive information unless it is reasonably necessary for our functions and we have consent or another lawful basis to collect it. Please avoid sending sensitive or confidential personal information unless it is needed for an agreed purpose.

How we collect information

We usually collect information directly from you when you email or call us, meet with us, request a proposal, engage our services, provide project materials, respond to us or otherwise work with us. We may also collect information automatically when you use our website, from people you authorise, from our service providers, or from publicly available professional sources.

If you provide personal information about another person, you should have authority to do so and, where appropriate, make them aware of this policy.

Why we use personal information

We collect, hold, use and disclose personal information where reasonably necessary to:

  • respond to enquiries and determine whether MAXYS can assist;
  • prepare proposals, enter into agreements and deliver, review and support our services;
  • manage client, supplier, contractor and professional relationships;
  • process invoices, maintain business records and meet tax, accounting and legal obligations;
  • operate, secure, diagnose and improve our website, systems and workflows;
  • understand website use and evaluate the effectiveness of our communications;
  • send relevant business communications or marketing where permitted, with an option to unsubscribe; and
  • protect our rights, prevent misuse and respond to lawful requests, disputes or safety concerns.

We do not sell or rent personal information.

AI-assisted services and project materials

Some MAXYS services use AI-assisted tools provided by OpenAI, Anthropic and Google to process project materials for agreed production or workflow purposes. Depending on the service and account configuration, project materials and associated personal information may be sent to and processed by these providers.

We keep human judgement and review in the process. Where a project requires handling that is materially different from this policy, we will address it in the relevant proposal, agreement or collection notice.

Cookies, analytics and embedded content

Our website uses cookies and similar technologies needed for site operation, security and administration. We also use Google Analytics through Google Site Kit to understand how the site is used. Analytics may collect information such as device and browser details, IP-derived location, pages viewed, referral source and interaction data. Google may process this information under its own privacy terms.

You can restrict or delete cookies through your browser settings. Blocking some cookies may affect website functions. Pages may also contain links or embedded content from third-party services, such as video or social platforms. Those providers may collect information as if you visited their service directly, and their own privacy policies apply.

Who we disclose information to

We may disclose personal information, only as reasonably necessary, to:

  • MAXYS personnel, contractors and collaborators involved in the relevant work;
  • our principal cloud, AI and hosting providers: Google for cloud, communications, collaboration and analytics; OpenAI and Anthropic for AI-assisted processing; and Rochen for website hosting and related infrastructure;
  • professional advisers, insurers and auditors;
  • government agencies, regulators, courts or law-enforcement bodies where required or authorised by law;
  • a party involved in a proposed or actual business restructure or transfer, subject to appropriate safeguards; or
  • another person where you have consented or would reasonably expect the disclosure.

Overseas processing and disclosure

Our principal providers operate internationally, so personal information may be processed or stored outside Australia. Based on their published service arrangements, likely locations include:

  • Google: servers and processing locations around the world, including the United States and other countries where Google or its service providers operate;
  • OpenAI: the United States and other countries or territories where its affiliates, partners, vendors and service providers operate;
  • Anthropic: processing in the United States, Australia, Europe and Asia, with commercial customer data stored in the United States by default unless otherwise agreed; and
  • Rochen: hosting infrastructure and support associated with data centres in Dallas, United States and London, United Kingdom, with some content-delivery, backup or approved subprocessor activity potentially occurring in other locations.

The exact location depends on the service, selected hosting region, account settings, routing and current subprocessors, and may change over time. Where required, we take reasonable steps in the circumstances to ensure overseas handling is consistent with applicable Australian privacy requirements.

How we protect and retain information

We use reasonable technical and organisational safeguards appropriate to the information and our operations. These may include access controls, authentication, secure service providers, backups, software updates and limiting access to people who need the information for their work. No internet transmission or storage system is completely secure.

We retain personal information only for as long as reasonably needed for the purpose for which it was collected, to maintain appropriate business and project records, or to meet legal, accounting, insurance and dispute-resolution requirements. When information is no longer required, we take reasonable steps to delete or de-identify it, subject to lawful retention needs and routine backup cycles.

Access and correction

You may ask for access to personal information we hold about you or request a correction if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details below and include enough information for us to identify the relevant records. We may need to verify your identity. If an exception permits us to refuse a request, we will explain the reason where required.

Direct marketing

We may send business updates or marketing where you have consented or where the law otherwise permits. You can opt out at any time by using an unsubscribe link or contacting us. We will action the request within a reasonable period, although we may still send service or administrative messages that are not marketing.

Privacy complaints

If you believe we have mishandled your personal information, email info@maxys.com.au with the subject “Privacy complaint”. Please describe what happened and the outcome you are seeking. We will acknowledge the complaint, investigate it and aim to respond within 30 days. If more time is needed, we will let you know.

If you are not satisfied with our response, you may be entitled to complain to the Office of the Australian Information Commissioner (OAIC).

Our website may link to services operated by others. We are not responsible for their privacy practices, and we encourage you to review their privacy information before providing personal information.
